They cover two different people. Anyone who scans a product and reads a verification page. And producers — companies who use the console to publish passports and provision tags. Section 4 applies to producers only.
A green “Authentic” result means one thing precisely: at that moment, a chip presented a code that only genuine chip could have produced, and that code had not been used before. That is strong evidence about the tag.
It is not a guarantee about the goods. A genuine tag can be applied to a counterfeit item by someone with access to both — which is why every provisioning action is attributed to an operator and a bench. Nor is it a statement about quality, safety, or fitness for any purpose.
Product information on a passport is supplied by the producer. We publish what they enter and check that it is well-formed; we do not verify that it is true. Claims about materials, footprint or origin are theirs.
You must not:
Automated access at a volume that degrades the service for people holding real products may be throttled or blocked.
You are responsible for the accuracy of everything you publish, for holding the rights to any content you upload, and for the lawfulness of your product claims in the markets you sell into. Where you configure an assistance programme, you are the controller of the applications it receives and you must give applicants your own privacy notice.
Tags are provisioned under dual control: a production batch must be approved by someone other than its creator. You must not attempt to defeat that, and you are responsible for the physical security of provisioned tags before they reach goods.
Your data remains yours. On termination you may export it, and we will delete it other than records we must keep — the append-only audit log, and scan records that concern the objects rather than you.
The pilot is provided without an availability commitment. Where verification cannot be completed the service says so plainly rather than guessing: an outage renders as “verification unavailable”, never as a verdict about the item. Commercial agreements may set service levels.
To the extent permitted by law, the service is provided “as is” during the pilot, without warranties. We do not exclude liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded — including, where it applies, statutory rights of consumers in the European Union, which are unaffected by these terms.
We may change these terms; the date above records when. Continued use after a change means acceptance. We may suspend access that breaches section 3, and you may stop using the service at any time.
pending — governing law and jurisdiction depend on which group entity contracts with you, and are settled as those entities are registered (see the legal notice). Commercial agreements state this explicitly. Nothing here deprives a consumer of the protection of the mandatory law of their country of residence.
